Samalah seperti tudung. Tudung pula yang disalahkan, " pakai tudung tak mestinya baik..bla...bla...bla..."

•*""*•.¸❤❤¸.•*"*•.¸❤ ❤¸.•*" "*•.¸❤❤¸.•*" "*•.¸❤ ❤¸.•*" "*•.¸❤

3. Macamlah kau bagus sangat nak tegur aku. Kau dulu lagi jahat nak mampos.

•*""*•.¸❤❤¸.•*"*•.¸❤ ❤¸.•*" "*•.¸❤❤¸.•*" "*•.¸❤ ❤¸.•*" "*•.¸❤

7. Walau kami tak bertudung, kami tetap solat dan puasa.

-Apakah ibadat kau diterima?

Lawan perintah Allah, Neraka tempatnya.

10. Kami pakai seksi macam ni, sebab ikut arahan photographer/pengarah filem untuk disesuaikan dalam scene. (ayat artis)

-Sanggup patuh arahan mereka daripada patuh suruhan Allah?

11. Bukan kami tak mahu menutup aurat, cuma masih belum sampai seru.

-Mati tidak mengenal usia. Tak takut ke mati dalam usia muda? Tak sempat nak bertaubat nanti.

•*""*•.¸❤❤¸.•*"*•.¸❤ ❤¸.•*" "*•.¸❤❤¸.•*" "*•.¸❤ ❤¸.•*" "*•.¸❤

Sultan Brunei: Who are we to say 'Wait'?

His Majesty on enforcing Islamic law

"WHO ARE WE, in the presence of Allah (SWT), to say 'no or wait'; considering that (Islamic) law was not only formulated, but has been stated in Al-Quran and Al-Hadiths for more than 1,400 years."

This was the message in the titah of His Majesty the Sultan and Yang Di-Pertuan of BruneiDarussalam who yesterday reiterated calls for Brunei to implement Islamic law, particularly through the establishment of an Islamic Criminal Act.

"This is among my main aspirations, which have long been voiced but until now it is still being addressed," the monarch said.

His Majesty raised the issue in his birthday titah on July 15, 1996 and more recently at a sitting of the Brunei Islamic Religious Council (MUIB) in March this year.

The sovereign has also urged authorities not to delay in introducing the Act during theMUIB meeting on Monday.

Voicing similar remarks yesterday, the monarch said that despite Brunei being small, the Sultanate has the resources and power to implement Islamic law. Its standing as a Muslim nation also makes it an obligation to carry it out.

"We have no other choice than to obey all of Allah's (SWT) commands."

"If we are still saying no or wait first, (then) this does not make sense," His Majesty said.

His Majesty put forward the notion that without the implementation of Islamic law, it puts into question Brunei's standing with Al-Quran and the Hadiths.

"Because of this, I am called, without any doubt, to see an Islamic Criminal Act established and implemented," His Majesty said, adding that the existing secular laws would not be "pushed" aside.

The monarch noted that the cooperation between the authorities who draft civil and Islamic laws was "good and (this) cooperation needed to be continued".

His Majesty said that Brunei has done something "magnificent and unique" in that it has managed to incorporate Islamic aspects into all its laws.

"We have been tailoring all the civil laws with the requirements of Islam, meaning that (we have) maintained the civil (laws) but in (a) shape and structure that is more based on Islam."

His Majesty was confident that with the implementation of the Islamic Criminal Act, the importance of civil laws will become more transparent.

"For example, when a criminal case cannot be addressed by Syariah (law) due to certain factors, then it will be addressed as a civil (law case), which has also been aligned toSyariah requirements."

"Is this not beautiful? In my opinion, it is very beautiful (and) unique," His Majesty added.

The monarch who was speaking at the opening of an international seminar held at theBridex hall in Jerudong said he hoped that the event will bring about new ideas that will expedite the establishment of the Islamic Criminal Act.

"I believe that Allah SWT is currently illuminating us with His blessings because of our aspirations, and even providing us with the strength to do so."

'Islamicising' Penal Code not impossible

BRUNEI'S Penal Code can be amended or substituted with new sections "so as to provide hudud, qisas and diyat according to Islamic Criminal Law", stated one of Brunei's most respected experts in Islamic Law at yesterday's session of the International Seminar on Islamic Law.

Dato Seri Laila Jasa Professor Dr Anwarullah informed participants that 61 out of 511 sections of the Penal Code can be amended or substituted, while 450 sections are not contrary to Islamic Law and can be retained.

In his paper "Differences Among the Schools of Islamic Fiqh and their Effect on the Implementation of Islamic Criminal Law in Brunei Darussalam", Prof Dr Anwarullah said although Brunei adheres to the Mazhab Syafi'i school of Islamic Fiqh of Ahli Sunnah Wal Jama'ah, any ruling that opposed public interest under this school, can still be appropriated under the remaining schools of Fiqh that is recognised by Brunei, namely Mazhab Maliki, Mazhab Hanafi and Mazhab Hanbali.

The specialist from the Legislative Unit under Ministry of Religious gave an example under the Penal Code Section 302, which provides for death punishment for committing murder whether the individual is Muslim or non-Muslim, which is also in accordance to the opinion of Mazhab Hanafi where both are equal in terms of homicide.

However, under Mazhab Syafi'i if a Muslim murders a non-Muslim, he will not be punished with death (qisas), but rather, according to Ahli Sunnah Wal Jama'ah, the heir of the victim can pardon the offender with or without compensation. "It is therefore suggested that a new section 302A may be added to the Penal Code to provide that in the case of murder, the heir of the victim may pardon the offender with or without compensation,"he said.

"If the victim has no heir, His Majesty the Sultan and Yang Di-Pertuan of Brunei Darussalam may pardon the offender with diyat(compensation)". The professor also cited other examples which include theft, causing hurt or bodily pain and zina (adultery) as well as rape.

In a separate interview, the professor said that "Islamicising" the Penal code "was very possible" in Brunei. "It is very easy(to implement the provisions in the Penal code). I think maybe by next year, InsyaAllah, this will happen. The Brunei Islamic Religious Council (Muib) and the Legislation Unit under MoRA have done very big work on it,"he said.

"There is really not a big difference (in the added provisions). Ninety per cent of the time we adhere to Mazhab Syafi'i," he said.

Asked how these provisions could be taken into effect, he said that it should be a collaborative work between Brunei's Islamic Religious Council (Muib), the Legislative Unit and the Attorney General's Office (AGC). The lecture took place at the BridEx Hall in Jerudong. The Brunei Times

Syariah-compliant penal code

Review to integrate Islamic laws into existing civil legislation

BRUNEI Darussalam will soon see the creation of a unique hybrid legal system where Islamic laws are integrated into existing civil legislation, making them Syariah-compliant.

All existing legislation in Brunei will be reviewed to ensure they are Syariah-compliant and amendments will be made to any sections that contradict Islamic law, said the Head of the Research and Law Review Division at the Attorney General's Chambers yesterday. "Instead of having a separate Act or set of laws to apply to Muslims, Syariah laws will be integrated into the existing Penal Code and other offences that are punishable under Hudud," said Senior Counsel Zuraini Hj Sharbawi.

Hudud crimes are offences where punishment has been set by Allah (SWT). Hudud laws cover six areas: theft, illicit sexual relations, making unproven accusations of illicit sex, drinking intoxicants, apostasy and robbery.

Zuraini explained that the reforms committee will be creating a new hybrid system that has not been seen anywhere in the world.

"It would be unique and very special to Brunei... We're not using a model from another country this is His Majesty's vision."

However, there are crimes which are not punishable under Hudud. These offences, called Takzir, will still be dealt with through the civil courts.

"When we bring it together there will no longer be Syariah courts or civil courts, there will be Hududcourts and Takzir courts," said the senior counsel.

Many people have voiced concern over some of the draconian punishments prescribed under Hudud, such as the severing of hands for theft or flogging for sex outside marriage.

"You have to understand the burden of proof is very, very difficult for Hudud," said Zuraini.

"It is highly likely that the majority of cases will end up in civil courts because the evidence does not meet the burden of proof under Hudud laws."

Citing an example, she said for someone to be punished for sex with a minor, there must be at least four witnesses to fulfil the burden of proof.

"In civil courts, cases must be proven beyond a reasonable doubt. In Syariah there must be no doubt."

A panel will be set up to analyse each case and determine whether a specific offence has sufficient evidence to proceed under the Hudud court.

The senior counsel said minor amendments to the Criminal Procedure Code (CPC) laws that outline the legal process will also be made.

"What we're trying to do now is have just one Syariah-compliant CPC which can be used for both Hududand Takzir courts. Because you're using the same one (for both courts) there is fairness in that."

"(We are trying to come up with it) as fast as we can. In His Majesty's titah it is clear he's not happy with waiting five more years, eight more years, so the urgency is there." The Brunei Times
